1. Acceptance of Terms
By accessing or using any website, application or service operated by CareBridge Connect (Pty) Ltd ("CareBridge Connect", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Use of Services
You agree to use our services only for lawful purposes and in accordance with these Terms. You must not:
- Use the services in any way that violates applicable South African or international laws.
- Transmit any material that is unlawful, harmful, threatening, abusive, defamatory or offensive.
- Attempt to gain unauthorised access to any part of our systems.
- Use automated means (bots, scrapers) to access our services without prior written permission.
- Interfere with or disrupt the integrity or performance of our services.
3. Intellectual Property
All content, software, trademarks, logos and intellectual property on our platforms are the exclusive property of CareBridge Connect (Pty) Ltd or our licensors. Nothing in these Terms grants you any right, title or licence to use our intellectual property except as expressly stated herein.
4. Accounts
Where our services require an account, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorised use at [email protected].
5. Disclaimers
Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. We do not warrant that the services will be uninterrupted, error-free or free of viruses.
6. Limitation of Liability
To the fullest extent permitted by South African law, CareBridge Connect shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages. Our total liability in any matter arising out of or related to your use of the services shall not exceed the amount paid by you for the services in the 12 months preceding the claim.
7. WhatsApp Business Services
Where our services integrate with WhatsApp Business Platform, your use is also subject to Meta Platforms' applicable terms and policies. You are responsible for ensuring you have the right to share any data you process through our WhatsApp-integrated features.
8. Privacy
Your use of our services is subject to our Privacy Policy and Data Policy, which are incorporated into these Terms by reference.
9. Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for any conduct that we believe violates these Terms or is harmful to other users, us or third parties, or for any other reason at our sole discretion.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.
11. Changes to Terms
We may modify these Terms at any time. Changes will be effective upon posting with an updated effective date. Your continued use of our services after such changes constitutes your acceptance of the revised Terms.
